Vosseler Abogados publicly denounces the administrative negligence that has paralyzed the criminal proceedings in the workplace accident that left Raúl Miralles seriously injured in Bacares (Almería). The case has been stalled for five months in the Court of Instruction No. 1 of Purchena for a bureaucratic and unacceptable reason: the lack of a staff member in the relevant section.
A file "in the drawer"
Raúl Miralles, 47, had his life tragically cut short on September 2, 2025, after falling 25 meters while clearing brush at Bacares Castle (pictured) for the local council. Today, Raúl remains hospitalized in a specialized center in Madrid, facing a potential disability that has forever altered his life and that of his family.
While he fights for his health, the complaint filed by Vosseler Abogados in October 2025 against the municipal officials is gathering dust in a drawer.
“This isn’t justice. It’s administrative cruelty,” states Ambar Zambrano, head of the labor law department at Vosseler Abogados. “Administrative time is not the time of a family that has lost its livelihood and its health. It’s unacceptable that a criminal case for gross negligence is stalled because a sick leave hasn’t been covered .”
Total negligence
The report from the Labor and Social Security Inspectorate is conclusive and describes the conditions under which Raúl worked as posing a " serious and evident risk ." According to the labor authority, the accident at Bacares Castle was entirely preventable had the minimum safety measures been followed.
- Absence of critical protectionsThe worker was working on rocky slopes of more than 20 meters without lifelines or anchor points.
- Inadequate equipmentThe helmet he was wearing lacked a chin strap, so it came off during the fall, leaving him completely unprotected.
- Lack of supervisionRaúl performed these high-risk tasks alone, without a specific safety plan or the presence of a preventative resource.
Given this evidence, the Inspection has already promoted the maximum 50% surcharge on benefits against the Bacares City Council, considering that its lack of foresight was the direct cause of the accident.
The human impact: A homeless family
Beyond the official reports and legal documents, there is a heartbreaking human reality stemming from this administrative negligence. Raúl's wife, with two young children to support, finds herself in a situation of absolute economic and legal insecurity .
