The responsibility of public administrations for the safety of their workers has once again come to the forefront of the media due to a workplace accident. Ambar Zambrano, head of the Labor Law department at Vosseler Abogados , recently appeared on the news program La Sexta to denounce the extremely serious irregularities that have left Raúl Miralles, a 47-year-old worker, paraplegic . During her appearance, the lawyer detailed the conclusions of the damning report from the Labor Inspectorate, which describes the preventive management of the Bacares Town Hall (Almería) as nonexistent.
An avoidable accident marked by a lack of safety
On September 2, 2025, Raúl Miralles was clearing brush near Bacares Castle when he fell 25 meters down a slope . The consequences have been devastating: a severe disability that has shattered his life and that of his family: his wife and two minor children.
As Zambrano explained on camera, the Labor Inspectorate has confirmed a " total absence of safety measures " in a "serious and evident" risk environment. Among the most critical violations in this workplace accident are:
- Lack of collective protections: No lifelines or anchor points were installed in areas with slopes of up to 25 meters.
- Inadequate equipmentThe worker was wearing a helmet that lacked a chin strap, which proved useless during the fall.
- Lack of evaluation and supervisionThere was no specific safety plan for working at heights and the operator was working alone, without any preventive resources present.
Due to these offenses, a 50% surcharge has been imposed on the economic benefits received by the worker, the maximum legally allowed.
The legal process is at a standstill.
Beyond the workplace negligence, Ambar Zambrano denounced on La Sexta the defenseless situation suffered by the victim due to the deficient functioning of the Justice Administration.
The criminal case, filed in the Court of First Instance No. 1 of Purchena, had been stalled for five months for a purely bureaucratic reason: the section handling the proceedings lacked a staff member. That staff member was finally hired this April.
"It's not justice. It's administrative cruelty. The administration's time is not the time of a family that has lost its livelihood and its health," Ambar Zambrano states emphatically.
