QUESTIONS AND ANSWERS:
1.- How can we quantify the damage suffered due to the abnormal functioning of the Administration?
It will vary depending on the city and the impact that the VTCs have had on them, taking into account the official data published by the different metropolitan taxi institutes of each city.
We may claim the income that we have stopped receiving due to the illegal entry of the VTC. If after the introduction of the VTC your income has suffered a drop of 30%, the annual amount that you can claim is approximately 10.000 euros as loss of past income.
Regarding future income, the net present value (calculated with the taxi's annual income of 30.000 euros net annually in perpetuity) of the taxi is approximately 500.000 euros. The damage that we can claim regarding this net current value will be proportional to the market share that the taxi has lost to competitors who have carried out professional intrusion in the sector due to the inaction of public administrations.
For example, if a taxi driver's income has decreased by 30% due to the illegal entry of VTCs, the net present value of his present and future activity will also have decreased by 30% (unless the situation is reversed in the future). ). Therefore, with respect to 500.000 euros, 150.000 euros will have been lost. This means that compensation for property damage worth 150.000 euros can be claimed (these numbers are approximate).
In any case, these calculations will be carried out by the accounting expert for each specific case depending on the location.
2.- How do I know the value of the compensation that corresponds to me for the damage suffered? It will be a different compensation depending on several parameters that are roughly specified below:
a) It will depend on each city based on the impact that the presence of the VTC has had according to the publications of the Metropolitan Taxi Institute of each municipality.
b) It will depend on the age of the license holder and the time remaining until retirement age.
c) It will depend on the acquisition price of the license if it is included once the VTCs are present and if said presence has had an impact on the price.
All these parameters will be taken into account by the economist experts to adapt the real damage to each of the assumptions, using corrective factors to adjust the reality of the damage.
3.- If I have sold or transferred my license to a third party, can I make a claim?
a) All those who have sold the license within a maximum period of one year prior to the date of the property claim (since July 2020) may claim and as long as the sale price has been reduced by the presence of the VTC. taking into account the comparison of sales prices from years prior to the presence of the VTC in each of the locations.
b) All those who have acquired the license with the VTC present (before and after their entry) may claim, regardless of the date of acquisition and its value.
