Vosseler Abogados has successfully settled the tragic traffic accident in Pozo Alcón (Jaén) , which occurred on August 5, 2022, on the A-326 highway, establishing compensation amounts exceeding one million euros for the victims and the family of Lars, the 30-year-old who lost his life in the accident . The final ruling orders the insurance companies AXA and SegurCaixa to jointly pay (50% each) the compensation for the death.
“After years of fighting, we have managed to get the insurance companies to compensate the family of the deceased with amounts that dignify the irreplaceable loss of a life,” says Álvaro Machado, a lawyer with Vosseler Abogados who legally represents the family. “It is a bittersweet victory considering the lenient sentences the driver, the perpetrator of the accident, faces.”
Breakdown of compensation
This multi-million dollar compensation ruling for a traffic accident now recognizes the serious harm caused to the deceased's partner and children, distributing the amounts in the ruling as follows:
- To the deceased's partner (Ms. AMRL): 227.852,04 euros.
- To his youngest daughter (ATRR): 67.294,53 euros.
- To his daughter (ALRM): 60.469,52 euros.
- To his son (AJRM): 43.912,02 euros.
It should be noted that the insurance companies had already "agreed" (agreed to partially pay) some of these amounts previously, the amount of 77.000 euros of the total, although the final ruling considerably increases these figures.
Interest and surcharges
In addition to the principal amounts, the judge has ordered the insurers to pay the interest stipulated in Article 20 of the Insurance Contract Law . This interest acts as a penalty for the delay in paying the appropriate compensation, significantly increasing the final amount received by the beneficiaries.
Context of the accident
The events leading to this multi-million euro compensation payment for an accident date back to the summer of 2022, when the defendant, JJMB, who was driving without a license and with an expired vehicle inspection certificate, ran off the road due to excessive speed (108 km/h) and crashed head-on into a tree. In the accident, in addition to the death of LARS, two other occupants were seriously injured.
The court has found the driver guilty of gross negligence , and he faces a potential sentence of up to four years in prison . While the criminal proceedings regarding criminal liability continue, this civil ruling guarantees financial support for the victim's minor children and partner.
