New traffic law: more protection in accidents

By August 6, 2025No Comments

Important news for everyone. A new traffic law came into effect on July 26th, bringing significant changes to how traffic accidents are handled. At Vosseler Abogados, we stay up-to-date to defend your rights, and this legislation reinforces our commitment to ensuring better protection for accident victims.

What has changed and why is it important to you?

And this new law follows that same line: it has the clear objective of better protecting accident victims. To achieve this, key aspects have been modified and concepts that previously caused practical problems for those affected have been clarified.

1. What is a “motor vehicle” now?

Previously, the law only considered motor vehicles to be those that had a roadworthiness permit. This left many people unprotected if an accident was caused by new vehicles such as high-powered electric scooters or fast electric bicycles. Now, the law expands this definition to include vehicles that:

  • They exceed 25 km/h.
  • Or, they weigh more than 25 kg and exceed 14 km/h.

This means that if you have an accident with one of these vehicles, you can be certain that insurance will cover you, even if the at-fault driver doesn't yet have it. In this case, the Insurance Compensation Consortium will handle the compensation, which is a great relief for victims, ensuring they won't be left without assistance.

2. The compensation for your damages will be fairer

We know that, after an accident, the priority is recovery. Therefore, compensation must be fair. The new law brings important improvements:

  • Improved calculation: The compensation scale is now updated using the IPC, which measures the real cost of living. This is much better than the previous method, which didn't reflect economic changes as well. In other words, your compensation will be more closely aligned with current realities.
  • Expanded coverage: The minimum amounts that insurers must cover are increased: up to 70 millones de euros for personal injury and 15 million for material damage. This ensures that, even in the most serious accidents, compensation will be guaranteed.
  • New rules and tablesThe law includes new tables for calculating compensation. The value of domestic work is now recognized, and the victim's family is better protected in the event of death.
  • Improvements in compensation: The economic amounts of the compensation concepts are updated.
3. The claims process will be more transparent and faster

Claiming compensation can be a long and complex process. The new law aims to simplify and make it more transparent.

  • Clear deadlinesInsurance companies are required to respond to your claim within a specified period. If they fail to do so or fail to adequately justify their offer, they may be penalized. Furthermore, the statute of limitations is suspended during the negotiation process.
  • You decide your medical centerThe law explicitly recognizes your right to choose the medical center where you want to receive treatment, and the insurer must reimburse the costs.
  • The certificates will be at zero cost For victims: Police and judicial authorities must provide a copy to the injured parties.
